Barry P. Helft Fellowship

The Barry P. Helft fellowship is a two-year program that aims to train the next generation of capital appellate defenders. The opportunity is posted to the CalCareers website during the Fall of even numbered years, and the fellowship begins in September of the following year.

Applicants must be California (CA) Bar members or eligible to take the CA Bar exam.
The positions are full-time, and they do receive benefits.

Overview of the Barry P. Helft Fellowship

The Barry P. Helft Fellowship is established with the aim of training the next generation of capital appellate defenders. This program is integral in enhancing the quality of representation for indigent appellate defendants in California, particularly in capital cases. It addresses the crucial issues of racial and class disparities in the justice system. The fellowship honors the legacy of Barry P. Helft, reflecting his significant contributions to legal defense.

Participants in the fellowship receive thorough instruction in California capital law, with a special focus on the appellate process. Throughout their tenure, they benefit from detailed mentorship and training, enriching their skills in legal research and writing.

Fellows collaborate with experienced appellate attorneys, engaging in activities such as client support, trial record evaluation, identification of potential legal issues, brainstorming innovative legal claims, and preparing arguments for the California Supreme Court. A key aspect of the fellowship is its emphasis on addressing systemic issues and contributing to amicus briefs that challenge racial and class biases in the criminal legal system.

This program is transformative, aimed at nurturing participants into proficient legal writers and advocates. It prioritizes increasing diversity in the appellate bar to improve intercultural understanding and advocate effectively for marginalized communities.

About Barry P. Helft

Barry P. Helft’s distinguished legal career spanned five decades, during which he made significant contributions to the legal field. He practiced in a wide range of courts, including the U.S. Supreme Court, and authored a comprehensive six-volume set on Texas criminal trial and appellate practice.

Additionally, Helft enriched the California Criminal Defense Practice set with his contributions and shared his extensive knowledge through law review articles and lectures at various law schools. His involvement in trial and appellate advocacy seminars further underscored his dedication to legal education and mentorship.

The fellowship, named in Barry Helft’s honor, pays tribute to his 25 years of service at OSPD and his substantial influence on California’s legal community. At OSPD, Barry’s career was notable for his ascent through every rank, from various deputy roles, including Training Director, to serving as the Interim State Public Defender. His unwavering dedication to nurturing the professional growth of lawyers set a standard within the organization.

This fellowship is a continuation of Barry’s legacy, particularly his commitment to developing legal talent. Barry’s guiding principle, a promise he made to every lawyer he mentored, was that they would leave OSPD more skilled and capable than when they arrived. This ethos is at the core of the fellowship, which aims to uphold Barry’s pledge.

By fostering the next generation of appellate defenders, the fellowship not only honors Barry’s memory but also ensures that his vision for smart, skilled appellate public defenders continues, benefiting both the lawyers and the clients they serve.
